Affiliate Program Terms and Conditions

 These Affiliate Terms and Conditions (“Terms”) govern participation in the SimRacerUK Affiliate Programme (“Programme”). By applying to or participating in the Programme, you (“Affiliate”, “you”, “your”) agree to be bound by these Terms.

1. Affiliate Application and Approval

1.1 Participation in the Programme is subject to approval at the sole discretion of SimRacerUK.
1.2 SimRacerUK reserves the right to accept or reject any application without obligation to provide a reason.
1.3 Approved affiliates will be notified via email and provided with access to affiliate tools and tracking links.

2. Affiliate Relationship

2.1 Nothing in these Terms creates a partnership, employment, agency, or joint venture between you and SimRacerUK.
2.2 You act as an independent contractor and have no authority to bind SimRacerUK.

3. Affiliate Links and Promotion

3.1 Affiliates may promote SimRacerUK using approved affiliate links and marketing materials only.
3.2 You must ensure that all promotional activity is lawful, accurate, and not misleading.
3.3 You must not:

• make false or exaggerated claims about our products or services

• impersonate SimRacerUK or present yourself as an employee

• engage in spam, unsolicited messaging, or deceptive practices

4. Compliance with Laws

4.1 You are responsible for complying with all applicable laws and regulations, including advertising, consumer protection, and data protection laws.
4.2 Where required, you must clearly disclose your affiliate relationship (e.g. “This post contains affiliate links”).

5. Commission and Payments

5.1 Commission rates and payment terms will be outlined separately within the affiliate platform or agreement.
5.2 Commissions are payable only on valid, tracked, and completed transactions.
5.3 SimRacerUK reserves the right to withhold or reverse commissions for:

• cancelled or refunded transactions

• fraudulent or suspicious activity

• breach of these Terms

6. Intellectual Property

6.1 All trademarks, logos, branding, and content provided remain the property of SimRacerUK.
6.2 You are granted a limited, non-exclusive, revocable licence to use approved materials solely for participation in the Programme.
6.3 This licence terminates immediately upon removal from the Programme.

7. Termination

7.1 Either party may terminate participation in the Programme at any time, with or without notice.
7.2 Upon termination, you must immediately stop using affiliate links and marketing materials.
7.3 Outstanding commissions may be forfeited if termination results from a breach of these Terms.

8. Limitation of Liability

8.1 SimRacerUK shall not be liable for indirect, incidental, or consequential losses arising from participation in the Programme.
8.2 SimRacerUK’s total liability shall not exceed the total commission paid to you in the preceding 12 months.

9. Modification of Terms

9.1 SimRacerUK reserves the right to update or amend these Terms at any time.
9.2 Continued participation in the Programme constitutes acceptance of any updated Terms.

10. Governing Law

10.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
10.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
