Definitions

1. Any reference to WhitePeak Solutions (the “Company” or “Seller” or “Us”), based in Southampton, Hampshire, United Kingdom (Registered Office), applies to the website www.simracer.uk, which is operated by us. As a user of the website (“you” or “your”), you acknowledge that any use of this website, including any transactions you make (“use/using”), is subject to the terms and conditions outlined below.
2. Please carefully read these terms and conditions before using the website or placing an order. We recommend printing a copy for future reference. Also, review our privacy policy regarding how we use your personal information.
3. Any reference to “You/Buyer/Purchaser” refers to any person, sole trader, partnership, business, body corporate, or other entity detailed in the relevant section of the sales invoice/order form, including all successors, heirs, and assigns. If a Buyer purchases in the course of trade, profession, vocation, or sport, they shall be considered a trade buyer. Consumer buyers retain their statutory rights.
4. We reserve the right to change these terms and conditions at any time. Changes take effect when posted on the website and are dated accordingly. It is your responsibility to read the terms upon each use, and continued use signifies your acceptance of the latest version.
5. When using certain WhitePeak Solutions services, brochures, websites, and publications, please review the additional information provided for detailed service usage instructions.
6. “Goods or equipment ordered” refers to the items detailed in the sales order form. Any additional parts, connecting components, or ancillary items not detailed in the form are not included in this agreement.
7. “Price” means the total cost, including VAT where applicable. Motorsport catalogs or brochures may exclude VAT and are strictly for Trade, Non-Consumer, Export, or Professional Purchasers. Prices quoted may fluctuate, and current prices are those confirmed at the time of order.

Orders and Acceptance

7.1. Orders placed on the website are subject to acceptance per these terms and conditions. 

7.2. After finalizing your order, we will send an acknowledgment email detailing the products ordered. This email does not confirm or accept the order.

7.3. Order acceptance and contract completion occur upon dispatch unless we notify you otherwise.

Accuracy of content
We have taken care in the preparation of the content of this website, in particular, to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately. However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given about the goods are approximate only.

General Conditions

1. “Working day” excludes Saturdays, Sundays, and public/bank holidays.
2. These terms apply to all WhitePeak Solutions Ltd quotations, contracts, and orders. Trade buyers accept that additional representations outside this agreement are non-binding.
3. Product descriptions, specifications, and images are for guidance only. Buyers should verify specifications directly with the manufacturer before purchase.
4. We reserve the right to correct errors in orders. Buyers must verify order details before submission. No liability is accepted for errors unless reported within seven days of receipt.
5. Delivery 5.1. Estimated timescales are provided at checkout. Delays may occur due to unforeseen circumstances, and WhitePeak Solutions is not liable for delays beyond estimated timescales. 5.2. Risk transfers to you upon product delivery or the first attempted delivery.
6. Payment 6.1. Payments are processed upon order placement. If we are unable to supply goods, you will be notified, and a refund or order delay will be offered. 6.2. We validate payment details against third-party databases for security. 6.3. Errors in listed prices may be corrected, and you will be given the option to confirm or cancel the order at the correct price. 6.4. Payments may be made via credit card, debit card, or PayPal.
7. Manufacturer warranties apply to all products.

Limitations of Liability

15.1. Nothing in these terms excludes or limits liability for death, personal injury, or fraud caused by negligence. 15.2. We strive to provide accurate website information but are not responsible for errors, outages, or website functionality. 15.3. WhitePeak Solutions is not liable for economic, goodwill, indirect, or consequential losses. 15.4. Our liability for losses shall be limited to the purchase amount paid.

1. Advice given by our representatives is based on information provided by you and should be independently verified.
2. Trade buyers acknowledge that liability for warranties beyond those expressly agreed upon is excluded.
3. Compatibility with modified vehicles is not guaranteed. Returns may be accepted at our discretion.
4. Alleged defective goods must be returned for inspection before replacement.
5. Competition-use parts have reduced durability, and claims for wear and tear will not be entertained.
6. WhitePeak Solutions is not liable for losses resulting from the inability to participate in competitions due to faulty goods.
7. No liability is accepted for buyer modifications to products supplied.
8. We are not responsible for failure to supply due to unforeseen circumstances (e.g., strikes, natural disasters).
9. Third-party rights are not conferred by this agreement.
10. Products are marketed for personal or competition use; business users should ensure appropriate insurance coverage.
11. WhitePeak Solutions is not responsible for delivery delays beyond its control.
12. Orders cannot be assigned or subcontracted without our written consent.
13. We reserve the right to assign or subcontract any obligations under this agreement.
14. If any part of these terms is deemed unenforceable, the remaining terms remain valid.

Order Cancellation & Returns

1. Consumers within the EU may cancel within 14 days of receiving goods, except for special-order items.
2. Cancellation must be in writing and reference the order number.
3. Goods must be returned in original condition at the buyer’s expense.
4. If not returned within 14 days, we may collect the goods and charge reasonable collection costs.
5. Refunds will be processed within 30 days, deducting customs fees where applicable.
6. Trade buyers may return goods within seven days, subject to a 10% restocking fee.

Jurisdiction

1. These terms are governed by English law, and disputes are subject to English courts.
